Terms of Service

 

  1. Acceptance of Terms

Welcome to Utah Valley Tennis Club (“the Club,” “we,” “us,” or “our”). By accessing or using any of the Club’s facilities, programs, services, website, or mobile applications (collectively, the “Services”), you (“Member,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”).

If you do not agree, you may not use our Services.

  1. Membership, Booking & Use of Facilities
  • Memberships, court bookings, private lessons, clinics, leagues, tournaments, and events are subject to availability, these Terms, and any posted Club rules.
  • You must provide accurate information during registration and keep your account information up to date.
  • Court Reservations and private lessons:
  • Cancellations must be made at least 24 hours in advance.
  • Late cancellations or no-shows will incur the full court fee.
  • The Club reserves the right to deny access, suspend, or terminate memberships for:
  • Conduct that violates these Terms or Club rules
  • Unsafe, disruptive, or inappropriate behavior
  • Failure to pay dues or fees
  1. Payment, Fees & Refunds
  • You agree to pay all applicable fees, dues, and taxes for Services.
  • Membership fees automatically renew according to your chosen plan unless canceled per Section 8.
  • Junior development membership allows you to hold a spot in the class.  The membership is charged whether the student shows up or not. If you don’t attend a class(es), it doesn’t entitle you to a refund or proration for the month.  One makeup opportunity will be provided each month. 
  • Price Changes: We will provide at least 30 days’ email notice before any increase in recurring fees or material billing changes.
  • Refunds:
  • Fees are non-refundable once the Service has commenced (e.g., court time used, lesson delivered).
  • Exceptions may be made for documented medical reasons, weather impacting outdoor courts or Club closure, at the Club’s discretion.
  1. Use of Facilities & Equipment
  • All use of courts, equipment, and facilities is at your own risk.
  • You must:
  • Use equipment properly and follow staff instructions
  • Comply with safety and etiquette rules
  • Wear proper tennis attire and non-marking tennis shoes
  • You are responsible for any damage you cause to Club property and may be charged for repairs or replacement.
  • Personal Equipment: The Club is not liable for loss, theft, or damage to personal items (e.g., rackets, bags). Members must use regulation tennis balls.
  1. Health, Safety & Assumption of Risk

Tennis is a physically demanding sport with inherent risks, including injury, illness, or death. By participating in any activity at the Club, you:

  • Acknowledge and voluntarily assume all risks, known and unknown
  • Represent that you are in good health and physically capable of participating
  • Agree to follow all health and safety protocols, including:
  • Posted rules
  • Public health guidelines
  • Infectious disease policies (e.g., symptom screening)

The Club may deny entry to anyone exhibiting symptoms of illness.

  1. Waiver & Release of Liability

In consideration of being permitted to use the Club’s facilities and participate in activities, you agree:

6.1 Voluntary Participation

You understand and voluntarily accept all risks associated with tennis, lessons, clinics, leagues, tournaments, and other activities.

6.2 Release

You release, waive, discharge, and hold harmless Utah Valley Tennis Club, its owners, officers, directors, employees, contractors, instructors, affiliates, and agents (“Club Parties”) from any and all claims, demands, or causes of action arising from injury, loss, or damage (including property damage or personal injury) sustained while using Club facilities or equipment, whether caused by negligence or otherwise.

6.3 Indemnification

You agree to indemnify and hold the Club Parties harmless from any third-party claims arising from your conduct, participation, or use of facilities.

6.4 Medical Consent

You consent to emergency medical treatment if needed and agree that Club Parties are not responsible for medical costs or outcomes.

This waiver applies to you, your family, heirs, assigns, and personal representatives.

  1. Photographs & Publicity

The Club may take photos and videos of members, guests, and participants during activities. These may be used for promotional, marketing, and educational purposes (e.g., website, social media, brochures).

By participating, you grant the Club a non-exclusive, royalty-free, perpetual license to use your likeness.

  1. Cancellation & Termination

8.1 Membership Terms and Cancellation Policy

All memberships begin upon the sign-up date (or the date the agreement is electronically or manually accepted).

  • Initial Commitment Period: Monthly memberships include an initial 60-day commitment period during which cancellation is not permitted.
  • Cancellation After Initial Period: After the 60-day commitment, members may cancel by providing at least 21 days’ written notice prior to their membership anniversary date (the recurring monthly date based on the sign-up date). Notice received less than 21 days before the anniversary will result in billing for the next month.
  • Membership on Hold: Members may place their membership on hold for up to 60 days by providing advance notice (21 Days), provided that membership capacity allows (holds will not be granted when the club is sold out or at full capacity). During a hold, membership access and billing are suspended. The membership will automatically reinstate at the end of the hold period, with billing and access resuming on the next anniversary date. Holds may not be used consecutively without approval.
  • General: All cancellations, holds, or changes must be submitted in writing (e.g., email or member portal). No refunds or credits will be issued for partial months. Annual/prepaid memberships may have separate terms.

8.2 Club Termination

The Club may suspend or terminate your membership or access immediately for:

  • Violation of these Terms or Club rules
  • Non-payment
  • Unsafe or inappropriate behavior

No refund will be issued for terminated memberships.

  1. Intellectual Property

All trademarks, logos, photos, videos, and materials created by the Club are its property or licensed to it. You may not reproduce, distribute, or use them without written consent.

  1. Limitation of Liability

To the fullest extent permitted by law:

  • Club Parties shall not be liable for indirect, incidental, special, consequential, or punitive damages.
  • Total liability for direct damages shall not exceed the amount you paid the Club in the 12 months preceding the incident.
  1. Modifications to Terms

We may update these Terms. Changes will be:

  • Posted on our website
  • Sent via email (if material)

Continued use of Services constitutes acceptance of updated Terms.

  1. Privacy

Your personal information is governed by our Privacy Policy (available on our website at utahvalleytennisclub.com/privacy-policy/). By using the Services, you consent to the collection, use, and disclosure of your data as described therein.

We will not sell your personal data without consent.

  1. Minors

Members under 18 must have a parent or legal guardian sign these Terms and any waiver. Parents/guardians:

  • Are bound by the waiver, release, and indemnification on behalf of the minor
  • Are responsible for the minor’s compliance with Club rules
  1. Force Majeure

The Club is not liable for failure to provide Services due to causes beyond its control, including:

  • Acts of God
  • Government orders
  • Facility maintenance or repairs
  • Utility or internet failures
  • Pandemics or public health emergencies

No refunds for closures, but the Club will offer make-up time or credits when feasible.

  1. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Utah.

Any dispute shall be resolved exclusively in state or federal courts in Utah County, Utah. The parties agree to attempt good-faith negotiation for 30 days. If unresolved, disputes will proceed to binding arbitration in Utah County under AAA rules. The prevailing party is entitled to reasonable attorney fees.

  1. Entire Agreement & Severability

These Terms, along with any signed policies or waivers, constitute the entire agreement between you and the Club.

If any provision is unenforceable, the remaining provisions remain in effect.

Mobile Terms of Service

The Utah Valley Tennis Club mobile message service (the “Service”) is operated by Utah Valley Tennis Club (“Utah Valley Tennis Club”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Utah Valley Tennis Club’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Utah Valley Tennis Club through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Utah Valley Tennis Club. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18666410389 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Utah Valley Tennis Club mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
